Terms of Service

These Terms of Service ("Terms") govern your use of the website soviapps.com ("Website") and any Shopify applications ("Apps") developed and published by Sovi Apps Inc. ("Sovi Apps", "we", "us", or "our"), a company incorporated in the Province of Ontario, Canada.

By accessing our Website or installing any of our Apps, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services

Sovi Apps develops and distributes Shopify applications, including but not limited to:

  • Bundable — a product bundling and kit-building app
  • Sociable — a social reviews integration app
  • Trackable — an order tracking and status app

Our Apps are distributed through the Shopify App Store and are subject to both these Terms and Shopify's own terms and policies.

2. Eligibility

You must be at least 18 years of age and have a valid Shopify store to use our Apps. By using our services, you represent that you meet these requirements.

3. Account and Store Access

When you install one of our Apps, you grant us access to certain data from your Shopify store as required for the App to function. You are responsible for maintaining the security of your Shopify account credentials. You must not share your account access with unauthorized parties.

4. Acceptable Use

You agree not to:

  • Use our Apps for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse engineer, decompile, or disassemble any of our Apps
  • Interfere with or disrupt the integrity or performance of our services
  • Use our Apps to transmit spam, malware, or other harmful content
  • Resell, sublicense, or redistribute our Apps without written permission

5. Fees and Payment

Some of our Apps are free, while others require a paid subscription. Paid plans are billed through Shopify's billing system. By subscribing to a paid plan, you authorize Shopify to charge the applicable fees to your account. Pricing is subject to change with 30 days' notice. Refunds are handled in accordance with Shopify's refund policies.

6. Intellectual Property

All content, code, designs, trademarks, and other intellectual property related to our Website and Apps are owned by Sovi Apps Inc. or its licensors. You may not copy, modify, or distribute any part of our services without prior written consent.

7. Data Handling

Your use of our Apps may involve the processing of personal information. Please refer to our Privacy Policy for details on how we collect, use, and protect data. We comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

8. Third-Party Services

Our Apps integrate with Shopify and may connect with other third-party services (such as Facebook for Sociable). We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

9. Disclaimer of Warranties

Our Website and Apps are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Sovi Apps Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Sovi Apps Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of our services or your violation of these Terms.

12. Termination

We may suspend or terminate your access to our services at any time for any reason, including violation of these Terms. You may stop using our services and uninstall our Apps at any time through your Shopify admin. Upon termination, sections relating to intellectual property, limitation of liability, and indemnification shall survive.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated Terms on our Website with a revised "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Ontario, Canada.
